GENERAL MEMBERSHIP TERMS AND CONDITIONS
- This agreement commences once you have indicated your acceptance in the Declaration section of the web sign up process or
- Your membership will start immediately or on your selected start date.
- You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen.
- You cannot transfer this agreement to anyone else.
- Membership is charged monthly in advance and will be on or about the 25 and last working day of each month.
- January payments will be deducted on or about the 20th of December.
- These terms and conditions are subject to change at any time giving 30 days written notice.
- 4 Elements reserves the right to withdraw any product at any time giving 30 days written notice.
- In the event of an unpaid account a mid-month debit order will be processed on or about the 18th of the following month.
- In the event that an attempt to deduct the monthly payment fails, the full outstanding balance will become due and payable.
- In the event of one or more of these terms, conditions, rules and regulations being unenforceable they will be regarded as removed
After three months of unsuccessful collection of payment the membership will be deemed as cancelled and a full joining fee will be applicable if the member wishes to rejoin.
The remaining clauses are still deemed valid.
- Refunds of incorrect debit orders or related fees will only be processed for a maximum period of 3 months. Please contact the finance department via Contact Us, should you have any queries about your payments.
- Participants involved in any activities offered by 4 Elements CrossFit may be photographed or videotaped during training. The undersigned hereby consents to the use of these photographs and/or videos without compensation, on the 4 Elements CrossFit website or in any editorial, promotional or advertising material produced and/or published by 4 Elements CrossFit.
- 4 Elements is authorised to store the member's personal information.
- 4 Elements reserves the right to send the member operational messaging by whatever channel is deemed appropriate.
Operational messaging relates specifically to feature/functionality of your membership.
- Where the member has agreed, 4 Elements reserves the right to contact the member with marketing related offers from time to time. The member may elect to unsubscribe from these communications at any point.
- All members with unpaid accounts will be suspended from all member privileges. These will be reinstated once all arrears have been settled.
- 1 and/or my estate hereby indemnify The Company (4 Elements) against any claim by myself or any person arising directly or indirectly from my death, injury, loss, or damage suffered by me or any person as a result of my use of the facilities or services, whether it be allegedly caused or contributed to by an act or omission by The Company, its directors, employees, contractors, consultants. agents and tenants.
- Members are required to conform to 4 Elements membership rules and regulations at all times which relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided that we give you advance notice of the change. Breach may result in the cancellation of your membership.
FEES, FREEZING AND RESIGNATIONS
- The Company does not want you to feel bound by a contract. Therefore, your membership may be cancelled with 30 days written notice. No membership will be removed unless the notice period has been given and all terms and conditions will be upheld until that point including paying your monthly fee
- No membership cancellations will be accepted in December.
- A joining fee will be applicable where the member has cancelled and later re-joins
- A member will be subject to an annual increase in membership fees of the Membership Agreement. 4 Elements reserves the right to implement discretionary fee changes at any time.
HEALTH & SAFETY TERMS
- The information given by you in entering this agreement is correct
- Our staff, gents, subcontractors and members are not medically trained and should you have any concerns with your health and fitness you should seek independent medical advice before engaging in any physical activity on our premises
- To the best of your knowledge and belief you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your heath, safety, comfort, wellbeing or physical condition.
Further. that you will advise us immediately should your heath or vulnerability to injury change. - You have read and understood this agreement and all of its Terms and Conditions before accepting them.
- The agreement will become binding upon both parties once you have signed below
- You are primarily responsible for your heath and wellbeing but we at 4 Elements
Our Commitment
Whilst we will respect your decision over your training regime we reserve the right to ask you not to exercise beyond what we reasonably believe to be your personal ability.
- We shall endeavour to maintain a safe environment for you to enjoy your exercise
- .We shall endeavour to ensure that our fitness trainers and staff are qualified to fitness industry standards.
- We shall at all limes keep confidential any information that you give us regarding your health
By my signature to this agreement, I acknowledge and confirm that this agreement was completed in full prior to me signing the same, and I warrant that all information therein contained is true and correct and that I abide by these terms and conditions.
